At Wal-Mart in Mexico, a Bribe Inquiry Silenced – NYTimes.com (David Barstow)

In September 2005, a senior Wal-Mart lawyer received an alarming e-mail from a former executive at the company’s largest foreign subsidiary, Wal-Mart de Mexico. In the e-mail and follow-up conversations, the former executive described how Wal-Mart de Mexico had orchestrated a campaign of bribery to win market dominance. In its rush to build stores, he said, the company had paid bribes to obtain permits in virtually every corner of the country.

The former executive gave names, dates and bribe amounts. He knew so much, he explained, because for years he had been the lawyer in charge of obtaining construction permits for Wal-Mart de Mexico.

Wal-Mart dispatched investigators to Mexico City, and within days they unearthed evidence of widespread bribery. They found a paper trail of hundreds of suspect payments totaling more than $24 million. They also found documents showing that Wal-Mart de Mexico’s top executives not only knew about the payments, but had taken steps to conceal them from Wal-Mart’s headquarters in Bentonville, Ark. In a confidential report to his superiors, Wal-Mart’s lead investigator, a former F.B.I. special agent, summed up their initial findings this way: “There is reasonable suspicion to believe that Mexican and USA laws have been violated.”

The lead investigator recommended that Wal-Mart expand the investigation.

Instead, an examination by The New York Times found, Wal-Mart’s leaders shut it down.

Google Is Faulted for Impeding U.S. Inquiry on Data Collection – NYTimes.com (David Streitfeld)

The finding, by the Federal Communications Commission, and the exasperated tone of the report were in marked contrast to the resolution of a separate inquiry two years ago. That investigation, by the Federal Trade Commission, accepted Google’s explanation that it was “mortified by what happened” while collecting information for its Street View project, and its promise to impose internal controls.

But since then, the F.C.C. said, Google repeatedly failed to respond to requests for e-mails and other information and refused to identify the employees involved.

“Although a world leader in digital search capability, Google took the position that searching its employees’ e-mail ‘would be a time-consuming and burdensome task,’ ” the report said. The commission also noted that Google stymied its efforts to learn more about the data collection because its main architect, an engineer who was not identified, had invoked his Fifth Amendment right against self-incrimination.

When the commission asked Google to identify those responsible for the program, Google “unilaterally determined that to do so would ‘serve no useful purpose,’ ” according to the F.C.C. report.

AOL to Sell Patents to Microsoft for $1.1 Billion – WSJ.com (Kristin Jones)

AOL Inc. AOL -0.16% agreed Monday to sell more than 800 patents and related applications, along with a nonexclusive license to its remaining portfolio of patents, to Microsoft Corp. MSFT +0.98% for about $1.1 billion.

“The agreement with Microsoft represents the culmination of a robust auction process for our patent portfolio,” said AOL Chief Executive Tim Armstrong.

The deal comes as the race for patents has heated up in the tech space. Among other recent deals, Google Inc. GOOG -0.45% agreed to acquire Motorola Mobility Holdings Inc. MMI -0.32% last year for about $12.5 billion, partly to secure its lucrative patent portfolio, and a number of bidders pursued Nortel Networks Corp.’s patents at auction as well.

UK hacker sentenced for stealing 8 million IDs – Technology & science – Security – msnbc.com (Matt Liebowitz)

A 23-year-old British hacker who swiped the identities of 8 million victims and shut down part of Nokia’s internal network for two weeks will spend the next 26 months behind bars.

Edward Pearson, from York, in Northern England, used several covert cyberweapons, including the notorious bank-account-stealing Zeus Trojan, to steal credit card numbers and other confidential data from his United Kingdom victims during an 18-month stretch ending Aug. 30, 2011, the Daily Mail reported.

On his computers, police found 200,000 stolen PayPal accounts, the numbers of 2,701 bank cards and 8,110,474 names, dates of birth and postcodes for U.K. residents. Police investigating Pearson’s fraud said if all the details of what he had harvested were printed out, it would fill 67,500 sheets of paper.

New iPad overly hot? Most tests say no – Gadgetbox on msnbc.com

Recent tests conducted by Consumer Reports suggest that the new iPad runs hotter than its predecessor. But further tests by other publications — who struggled to replicate the heat levels observed by Consumer Reports — point out that this particular result doesn’t necessarily mean that the device is overly hot.

Based on Consumer Reports’ tests, the new iPad hits temperatures of up to 116 degrees Fahrenheit after about 45 minutes of running an intense-action game. This is up to 14 degrees F warmer than the iPad 2 will run under similar conditions, according to the publication.

After Consumer Reports’ report came out, other publications — such as Wired and PC World— conducted similar temperature tests. Their results and conclusions didn’t precisely line up with Consumer Reports’.

Jurors Say Digital Evidence Convinced Them of Dharun Ravi’s Guilt – NYTimes.com (DAVID M. HALBFINGER and BETH KORMANIK)

Dharun Ravi was not accused of causing the death of Tyler Clementi, his Rutgers University roommate who jumped off a bridge after Mr. Ravi used a webcam to spy on him kissing a man in their dorm and then talked about it on Twitter.

But for members of the jury, some of the most convincing evidence of Mr. Ravi’s guilt came from Mr. Clementi’s own complaints and online behavior after he learned of Mr. Ravi’s spying. And Mr. Clementi’s words echoed even more powerfully because he was not available to repeat them.

“It was pretty hard to think about Tyler, because he wasn’t present to give his thoughts,” said Kashad Leverett, 20, of South Amboy, N.J., after he and 11 other jurors delivered a guilty verdict on all charges, including invasion of privacy and bias intimidation, on Friday. “But in the evidence that was provided, it showed that he believed he was being intimidated because of his sexual orientation.”
