The Sedona Conference® Publishes Primer on Social Media (Pubic Comment Version) : Electronic Discovery Law

This month, the Sedona Conference® published a public comment version of its latest paper, The Sedona Conference® Primer on Social Media.  The primer, a somewhat different publication than prior commentaries, is described in its Preface as follows:

Unlike many of previous publications in this series, this is not entitled a “Commentary,” nor does it present any formal “Principles,” although it contains plenty of practical guidance for attorneys, judges, and parties.  This is called a “Primer” because the goal is to provide primary instruction to the bar and bench in the basics of social media and the law, from definitions, to the use of social media in business, to the discovery of social media in litigation, to professional responsibilities lawyers have in relation to their own use of social media.  This is a fast-developing and fast-changing area of technical, social, and legal development, and any consensus-based Commentary or set of Principles that claims to advance the law in this area may be doomed to obsolescence as soon as it is announced on Twitter.  However, we hope that this Primer represents a positive first step in grounding the dialogue leading to consensus on moving the law forward in the reasoned and just way.

This publication is available for download from The Sedona Conference®, here.

Twitter’s Giving You Your Data Back, Enables Archiving | Fast Company (Kit Eaton)

Twitter is enabling users to download an archive of all the content they’ve transmitted through its social networking systems. Simply by visiting their Twitter profile on the web, then visiting the Settings page and hitting the “Your Twitter Archive” option, users activate the service. A personalized email then arrives with a link to download a zip file that contains the archive in HTML format, including each tweet’s metadata–meaning it’s searchable using standard tools.

How to erase personal data on electronic devices | abc7news.com (Michael Finney)

People get rid of 30 million computers and more than 120 million cell phones every year. Before you dispose of your electronic devices, don’t make the mistake of failing to erase your personal data. Consumer Reports shows you how.

What’s on your personal computer? Your name, your bank account, even your credit-card information. Same with your phone. And recycling electronic devices without erasing that info is asking for trouble.

“You’re literally giving your personal information out to the criminal world,” said Larry Daniel with Guardian Digital Forensics.

The best way to protect yourself is erase your personal data. On the iPhone it’s easy; go to “settings” click on “general” then press “reset” and select “erase all content and settings.”

Consumer Reports’ computer expert Dean Gallea says erasing info on Android phones is a little more complicated. Usually you go to ‘settings,’ and choose ‘privacy.’ Then you have to consult the manual online for the next steps.

To erase a personal computer, you need to download software. A good choice is from dban.org.

“You download the software and put it onto a CD. Then you put the CD into the computer’s disc drive and follow the instructions to erase the hard drive’s contents,” said Gallea.

With Apple computers, the original operating-system DVD comes with software to erase your files.

“You put it into the computer’s disc drive and you reboot it, holding down the ‘C’ key during startup,” said Gallea.

Google’s Brin: ‘Worried’ about open Web – The Washington Post (Hayley Tsukayama)

“There’s a lot to be lost,” he told the newspaper. “For example, all the information in apps — that data is not crawlable by Web crawlers. You can’t search it.”

He was particularly critical of Facebook, whose rules, he said, are “really restrictive,” making it hard to transfer contact data out of the social network. Users can download an archive of information on Facebook but cannot convert that data easily to other services. Google has recently taken steps to integrate its social graph into search with Google+ and Search Your World, which serves personalized results to queries typed into Google’s engine. The changes, which are optional for users, have not been popular with some consumers.

Brin said he was troubled by censorship of the Web in countries around the world, such as China and Saudi Arabia, where governments can seemingly turn off the Web for long stretches of time.

Apple launches $69 OS X Lion thumb drive for those who can’t download it | VentureBeat

Apple on Tuesday launched a Mac OS X Lion thumb drive for people who wanted to uncage their own copy but didn’t have a strong enough Internet connection or capped bandwidth.

When Apple released Lion back in July, the decision to only offer Lion as a 4GB download was seen as groundbreaking and a new standard for future software releases. But it peeved some customers who don’t have fast Internet or use an ISP with bandwidth limitations. Apple’s only solution to that problem was to let customers download it using a Wi-Fi connection at the Apple Store. Of course, not everyone lives near an Apple Store.

The thumb drive ships in between one and three business days and you must have at least 7GB of free hard drive space to install it. Users that install with the thumb drive will not have access to the Lion Recovery option and will need to re-install the OS with thumb drive if they run into problems.
