Cisco Systems Inc (CSCO.O) is testing its TelePresence videoconferencing system and expects to begin selling a device to consumers late this year for around $500, a senior executive said on Thursday.

Robert Lloyd, Cisco’s executive vice president overseeing worldwide operations, told the Reuters Global Technology Summit in San Francisco that he is currently testing a TelePresence device at home.

The device would incorporate a high-definition camera and network technology to make video conversations smoother, he said.

AT&T Sees NY Network Upgrades Wrapped Up By 3Q, SF By 4Q – WSJ.com

AT&T Inc. (T) is expected to wrap up its network improvements for New York by the third quarter, with San Francisco to follow three months later, according to the company’s operations chief.

The Dallas telecommunications giant is working to upgrade its network in the two key media markets, which were hit by intense traffic primarily caused by the Apple Inc. (AAPL) iPhone. But the company has been delayed by component shortages and zoning issues, which have been particularly cumbersome in San Francisco.

The improvements are critical to AT&T repairing the reputation of the network, which suffers from the perception that its coverage lags behind rival Verizon Wireless. It also will enable the company to offer additional features, such as tethering for the iPhone, which allows a handset’s cellular signal to be used like a modem.

Other AT&T smartphones allow tethering.

“It’s taking longer than we’d like,” said John Stankey, chief executive of AT&T Operations, in an interview with Dow Jones. “The dynamics of San Francisco are different.”

The New York improvements are proceeding on schedule, he said, adding that the work in San Francisco is roughly 90 days behind as a result of the logistical complications.

Last month, the company said the number of dropped calls on its third-generation, or 3G, network fell 6% in Manhattan and 9% in the New York metropolitan area, but acknowledged that San Francisco was behind. Earlier Wednesday, Ralph de la Vega, who runs AT&T’s wireless and consumer businesses, told investors that the New York metrics have “improved significantly.”

Microsoft Accuses Salesforce.com of Infringing Software Patents – BusinessWeek

Microsoft Corp. said it sued Salesforce.com Inc. today, accusing the company of infringing nine patents for ways to make software more efficient.

The complaint targets the customer-relationship management, or CRM, software that is the hallmark of Salesforce.com’s business. It seeks a court order that would prevent the San Francisco-based company from providing features that Microsoft claims it invented.

Salesforce.com, founded in 1999, offers software that businesses subscribe to and use over the Internet for running marketing campaigns and tracking sales leads. It competes against Microsoft’s Dynamics software in the CRM market.

“Microsoft has been a leader and innovator in the software industry for decades and continues to invest billions of dollars each year in bringing great software products and services to market,” said Horacio Gutierrez, the Redmond, Washington-based company’s deputy general counsel for intellectual property and licensing. Microsoft “cannot stand idly by when others infringe” our intellectual property rights, he said.

The complaint was filed in federal court in Seattle after more than a year of talks, according to Microsoft, the world’s biggest software maker.

Toyota Lawsuit Judge Names Lead Attorneys for Cases – BusinessWeek

The federal judge overseeing sudden- acceleration lawsuits against Toyota Motor Corp. appointed 21 plaintiffs’ lawyers to manage litigation involving U.S. claims.

Toyota, the world’s largest automaker, faces at least 228 federal and 99 state lawsuits including proposed class actions over economic loss and claims of personal injuries or deaths caused by sudden-acceleration incidents. The federal lawsuits were combined April 9 in a multidistrict litigation, or MDL, before U.S. District Judge James V. Selna in Santa Ana, California.

More than 70 plaintiffs’ lawyers sought appointments to leadership positions in the federal lawsuits, including about 60 who spoke at a hearing before Selna yesterday.

Selna’s appointments today include Steve Berman at Hagens Berman Sobol Shapiro LLP in Seattle as co-lead counsel for economic loss plaintiffs and Elizabeth Cabraser at Lieff Cabraser Heimann & Bernstein LLP in San Francisco as co-lead for personal injury and death cases.

HTC Sues Apple, With Help From Troll | The Recorder

HTC Corp. retaliated against Apple Inc. on Wednesday with its own patent infringement complaint — and the patents come from a surprising source.

Three of the five patents that HTC says Apple is infringing on with its iPhone, iPad and iPod Touch were owned by patent troll Saxon Innovations LLC. HTC, the Taiwanese Google-phone maker, appears to have gotten the IP as part of a settlement with Saxon in the spring of 2009. The other two are HTC patents, including one that was issued Tuesday, which helps explain the timing of the complaint.

The countersuit before the International Trade Commission is a response to Apple’s volley of lawsuits against HTC in the ITC and Delaware District Court in March. Apple claims that HTC’s phones, which run Google Inc.’s operating system, infringe on 10 of its patents — sending a forceful message about the growing rivalry between Apple and Google in the smart phone market.

Since the March offensive, there has been a persistent question about how HTC would respond. The company has a much smaller patent portfolio than Apple (hundreds versus thousands), which can be like holding a butter knife at a gun fight.

HTC hired Finnegan, Henderson, Farabow, Garrett & Dunner and San Francisco's Keker & Van Nest to defend it against Apple and its lawyers at Kirkland & Ellis.

The lawyers looked at HTC's IP and came up with two patents on controlling the power levels in smart phones — including the one issued Tuesday — that it claims Apple's iPhones infringe on.

The other three patents cover a “Telephone Dialler with a Personalized Page Organization of Telephone Directory Memory.” According to patent filings, Saxon transferred them to HTC on March 31, 2009 — the same day that HTC settled a complaint that Saxon, a patent troll funded by Altitude Capital Partners, had filed in the ITC.

McDonald’s to Use Facebook’s Upcoming Location Feature – Advertising Age – Digital

Facebook is preparing to launch location-based status updates for its users. But the social network is also planning to offer it to marketers, including McDonald’s.

As early as this month, the social-networking site will give users the ability to post their location within a status update. McDonald’s, through digital agency Tribal DDB, Chicago, is building an app with Facebook would allow users to check in at one of its restaurants and have a featured product appear in the post, such as an Angus Quarter Pounder, say executives close to the deal.

Facebook is not directly charging McDonald’s to build the app; Facebook generally does not charge developers to build on its platform. But executives with knowledge say it was negotiated as part of a bigger media buy on Facebook, and McDonald’s will be the first marketer to take advantage of the service.

The fast feeder won’t be alone for long. While McDonald’s is expected to be involved in the rollout in the next few weeks, execs at other digital shops have begun to spec out location-based campaigns in anticipation of Facebook’s impending functionality, which will allow users to include their location in a status update.

San Francisco-based digital marketing firm Context Optional is working on Facebook location features for its retail clients. “It’s supposed to come out this month,” Context Optional CEO Kevin Barenblat said. “So we’re getting ready to incorporate it. We just don&’t know exactly when it’s going to be available.”

Hey Sony, Don’t Mess with Linux, Says PS3 Lawsuit – PCWorld

When Sony nerfed Linux support for the PS3 in early April, we knew it was only a matter of time before someone pulled a pack of lawyers out of their pocket.

Sure enough, a complaint (PDF courtesy IGN) filed in San Francisco federal court Tuesday is after class action status to wring compensation from Sony for yanking what some considered a quintessential feature of the company's flagship games console.

Unlike the Xbox 360 or Wii, the PS3 shipped in 2006 with an option to run alternative operating systems, including popular Linux distributions from Debian, Fedora, OpenSUSE and Ubuntu. The “slim” model refresh that appeared last September lost this feature, but Sony exempted older “fat” PS3s.

On April 1, PS3 firmware update 3.21 disabled the “Install Other OS” feature, ostensibly because Sony deemed it a hacker loophole. PS3 owners didn't have to install the update, but failing to do so locked them out of the PlayStation Network, playing newer gamers, viewing Blu-ray movies, and playing copyright-protected videos streamed off a media server. Not much of a choice, in other words.

The suit seeks to redress Sony’s downgrade, claiming that it’s “not only a breach of the sales contract…but it is also an unfair and deceptive business practice perpetrated on millions of unsuspecting consumers.”

“Sony knowingly and willingly accepted monetary benefits from Plaintiff and the Class, but Sony did not honor its obligations,” reads the complaint. “Rather, Sony benefited from the sales of PS3s with the Other OS function which it then forced purchasers to either disable or forgo other important PS3 functions.”
