Microsoft Sued Over Phone Tracking – Security – Privacy – Informationweek

Microsoft on Wednesday was sued in a district court in Seattle for allegedly tracking Windows Phone users without consent.

Plaintiff Rebecca Cousineau claims in the complaint that Microsoft is racing to develop a targeted location-based advertising system and has to map the locations of cell towers, wireless routers, mobile phones, and computers to do so effectively. The complaint alleges that Microsoft chose to collect this information from Windows Phone users rather than go through the expensive and laborious process of collecting the information itself.

“Microsoft’s scheme is executed through its camera application, which comes standard with a mobile device running the Windows Phone OS,” the complaint states.

The crux of the complaint is that Microsoft asks the user for permission to use his or her location the first time the camera application is opened and then ignores the user’s choice, collecting location data whether or not the user has consented.

Spotify has been available in the U.S. for two weeks now, and already finds itself involved in a patent battle. San Diego-based PacketVideo has filed a patent infringement suit against Spotify in the U.S. and Europe over its cloud-based music service.

PacketVideo filed suit in the Netherlands and San Diego district court after attempts to broker a licensing deal with Spotify were unsuccessful, PacketVideo said. “PacketVideo has a strong intellectual property portfolio, and will take any necessary action needed to protect its intellectual property and prevent the misuse of its patents,” Joel Espelien, general counsel for PacketVideo, said in a statement.

The suit covers one U.S. patent and one European patent, both of which “enables Spotify’s cloud-based music service,” PacketVideo said. Both patents were originally filed in the mid-1990s and were acquired by PacketVideo when it bought Switzerland-based SDC AG in 2007. The U.S. patent covers a “device for the distribution of music in digital form” and was issued in 1997.

Google Sued by PayPal Over Claims It Stole Trade Secrets – Bloomberg

Google Inc. was sued by PayPal Inc., the fastest-growing unit at online marketplace EBay Inc. (EBAY), over claims it misappropriated trade secrets from PayPal’s mobile- payment business.

Osama Bedier, a former PayPal executive now at Google, stole PayPal’s confidential information, the company said in the lawsuit filed yesterday in state court in San Jose, California. Stephanie Tilenius, another ex-PayPal executive now at Google, violated contractual obligations by recruiting Bedier, PayPal said.

Bedier “is now leading Google’s efforts to bring point-of- sale technologies and services to retailers on its behalf,” according to the complaint. “Bedier and Google have misappropriated PayPal trade secrets by disclosing them within Google and to major retailers.”

Both companies are trying to move into storefronts from online transactions and build their mobile businesses. PayPal, based in San Jose, is working with major retailers to develop a new type of point-of-sale system — the equipment next to cash registers where consumers swipe credit cards.

YouPorn Sued Over Alleged Browser ‘History Sniffing’ | News & Opinion | PCMag.com

Two California men have filed a class-action suit against Midstream Media, which owns the YouPorn adult Web sites, for allegedly tracking their online behavior via surreptitious a JavaScript code known as “history sniffing.”

YouPorn is involved in an “illegal and intrusive scheme” designed to peer into the men’s lives and collect personal information about them, according to the lawsuit, which was filed Friday in California district court.

David Pitner and Jared Reagan, both of Newport Beach, visited YouPorn and later discovered that their Internet activity was being tracked by the site.

“By embedding JavaScript code on its Web site designed to present [Pitner and Reagan's] Web browsers with a list of URL’s, [YouPorn] was able to obtain from [their] Web history files whether [they] had visited a variety of different Web sites or not,” according to the suit. “This ‘sniffing history’ manipulates the fact that browsers display links differently depending on whether or not their target has been visited.”

The men do not explain how they discovered that their activity was being tracked, but a day before their lawsuit was filed, researchers at the University of California-San Diego published a paper that detailed how “history sniffing” works.
