Wal-Mart Discloses Internal FCPA Review – WSJ

Wal-Mart Stores Inc. disclosed late Thursday that it had started an internal review into potential violations of a U.S. foreign bribery law.

The global retailer said in its quarterly report that it had voluntarily contacted the U.S. Department of Justice and the Securities and Exchange Commission about the investigation.

“[T]he Company has begun an internal investigation into whether certain matters, including permitting, licensing and inspections, were in compliance with the U.S. Foreign Corrupt Practices Act,” the company said.

Facebook, Myspace, Fair Game as Evidence in Court – Law Blog – WSJ

Recent plaintiffs continue to find themselves slapped with evidence from social networking sites that endanger or even completely derail their cases, despite attempts to argue that such information is protected.

We’ve written before about the growing trend of lawyers mining social media sites for evidence against opposing parties, and recent court decisions have affirmed the unprivileged nature of said information.

For instance, both parties to a case asked a district court in Pennsylvania last month to conduct a review of the plaintiff’s social networking profiles to determine what was subject to discovery.

The court proceeded to identify relevant information, such as “photographs and comments suggesting he may have recently ridden a mule,” which the court thought the defense could used to argue against the plaintiff’s claims that a car accident had left him physically and psychologically injured. A Tale of Two Law-Firm Tiers: The Top 23 and All the Rest – Law Blog – WSJ

It’s the first of June, when we’re reminded that there are not merely 100 corporate law firms that earn lots of money.

No, folks, there are 200 members of the BigLaw universe, all of which get their due today in the American Lawyer’s annual listing of  the highest-grossing firms.

Here’s an overview of the second hundred firms in the AmLaw 200, which enjoyed combined 2% revenue growth in 2010 and an average 3.4% bump in partner profits, the AmLaw reports.

Aric Press, ALM’s editor in chief, offers this interesting piece about a pattern that became pronounced in FY 2010:  a super-tier of  23 firms is starting to distance itself from the rest of the AmLaw 200 pack when it comes to profitability.

Average partner profits at the T-23 firms was $1.1 million higher than the average of the next 27 most profitable firms — a gap that has almost doubled in the last decade.

SciClone Reports Possible FCPA Violations To DOJ, SEC – Corruption Currents – WSJ

An internal investigation by SciClone Pharmaceuticals Inc. uncovered evidence of sales and marketing activities that might violate the Foreign Corrupt Practices Act, the company said Tuesday. SciClone previously disclosed that a special committee of directors was investigating operations in China for compliance with the law, which bars foreign bribery.

An FCPA Compliance Defense? No Way, Breuer Says – Corruption Currents – WSJ

The chief of the Justice Department’s Criminal Division flatly rejected the need for a compliance defense in the FCPA, saying “we can’t engage in some sort of formalistic solution from a script that says if you check the following six boxes you’re guaranteed this outcome.” His comments came two days after the U.K. government issued six principles for complying with the country’s Bribery Act.
